Terms & Conditions
1. As a member of the Plan, all benefits are available to you up to the $100.00 per occurrence benefit limit without any additionalpayments. Members are responsible for any non-covered expenses.
2. Each covered vehicle will be permitted an aggregate (total) of benefit occurrences that are covered by the Plan of up to three (3)covered occurrences per membership plan for 6 months and up to four (4) covered occurrences per membership plan for 12months.
3. Your membership will begin three (3) days after the purchase date shown on this membership application and will continue for theperiod selected on the application, unless cancelled. This membership is not transferrable.
4. All Roadside Assistance Membership services are provided by Auto Knight Motor Club, Inc., administrative offices at 1009 N. PalmCanyon Drive, Palm Springs, CA 92262.
5. In the event that service is not obtainable through Auto Knight, upon your written request you may receive a refund of paymentsmade for services received independently according to the coverage limits outlined in this Agreement. You must first contact AutoKnight for authorization to obtain independent services. You have the right to file a compliment or complaint by submitting a writtenletter to our Membership Department at 1009 N. Palm Canyon Drive, Palm Springs, CA 92262; contacting a representative by callingtoll-free; or via our website at www.autoknight.com.
All of the benefits and services of your membership are described herein and are applicable throughout the United States andCanada.
However, it is important that you understand this is a Motor Club Membership, and:
1. Except in Wisconsin, this is not an Automobile Liability insurance contract.
2. This is not an Automobile Physical Damage insurance contract.Emergency Roadside Assistance is available throughout the United States and Canada, 24 hours a day, 365 days a year. You willonly have to pay for any costs in excess of the $100.00 per occurrence limit plus any non-covered costs.
The following conditionsmust apply to qualify for coverage for covered emergencies:
1. Membership benefits extend to the Covered Member only. “Covered Member” is defined as the Member listed on this applicationand registered with Auto Knight.
2. Just call the TOLL-FREE number on the registration page of this agreement, and a service vehicle will be dispatched to yourassistance. Important: Please be with your vehicle when the service provider arrives, as they cannot service an unattended vehicle;You will be charged a fee for any unattended service attempts. Service provided must be a covered benefit under the terms andconditions of this Agreement.
3. Note: Assistance obtained through any source other than Auto Knight is not covered and is not reimbursable. Yourmembership must be active, and you must contact Auto Knight directly for service. In the event that Auto Knight is unable to provideservice, upon your written request you will be authorized by Auto Knight to obtain service from another service provider. In this event,you will be reimbursed for any payments made for authorized covered services up to the specified benefit limits. Otherwise, servicesecured through any source other than Auto Knight will not be reimbursed.
The following are covered Roadside Assistance benefits, subject to the $100.00 per occurrence limitation and the aggregatecovered occurrences limitation, unless otherwise noted:
(1.) Towing Assistance - When towing is necessary, the disabled vehicle of the Covered Member will be towed to the nearestqualified service facility.
(2.) Battery Service - If a battery failure occurs, a jump start will be applied to start the Covered Member’s vehicle.
(3.) Flat Tire Assistance - Service consists of the removal of the Covered Member’s flat tire and its replacement with the spare tire;if no spare is available, vehicle will be towed to nearest service facility (under the limits of the towing benefit).
(4.) Gasoline, Oil, Fluid and Water Delivery Service - An emergency supply of up to three (3) gallons of gasoline, oil, fluid andwater will be delivered to the Covered Member if the Covered Member’s vehicle is in an immediate need. You must pay for the fuelor other fluid when it is delivered.
(5.) Lock-out Assistance - If Covered Member’s keys are locked inside the vehicle, Auto Knight will provide for assistance gainingentry to the vehicle.
The following items are not included as part of the emergency Roadside Assistance benefit: Coverage shall not be provided inthe event of emergencies resulting from the use of intoxicants or narcotics, or the use of the Covered Member’s vehicle in thecommission of a felony. Cost of parts, replacement keys, fluids, lubricants, or cost of fuel, material, additional labor relating to towing,or the cost of installation of products. Â Non-emergency towing or other non-emergency service. Any service available through a validmanufacturer’s warranty or service. Non-emergency mounting or removing of snow tires or chains. Shoveling snow from around avehicle. Tire Repair. Extrication. Winching. Motorcycles, trucks over one and a half ton capacity, antique vehicles (meaning vehiclesover 20 years old or out of manufacture for 10 years or more), taxicabs, limousines, or other commercial vehicles. RecreationalVehicles (RVs), camping trailers, travel trailers, or any vehicles in tow. Any and all taxes or fines. Damage or disablement due to fire,flood or vandalism. Towing from or repair work performed at a service station, garage or repair shop. Towing by other than a licensedservice station or garage; vehicle storage charges; a second tow, or other benefit related to the same occurrence. Service on avehicle that is not in a safe condition to be towed or serviced that may result in damage to the vehicle if towed or serviced. Towing orservice on roads not regularly maintained, such as sand beaches, open fields, forests, and areas designated as not passable due toconstruction, etc. Towing at the direction of a law enforcement officer relating to traffic obstruction, impoundment, abandonment,2/3illegal parking, or other violations of law. Repeated service calls for a Covered Member’s vehicle in need of routine maintenance orrepair. Only one disablement for the same service type during any seven day period will be accepted. Services received independently from Auto Knight without prior authorization from Auto Knight. Only three (3) covered occurrences are provided for asix (6) month membership or only up to four (4) covered occurrences are provided for a twelve month membership. THIS IS NOT AROADSIDE ASSISTANCE REIMBURSEMENT SERVICE.
CANCELLATION - You or Auto Knight may cancel this Agreement at any time during the Membership Agreement period by sendingthe other party written notification of such cancellation. You may cancel this Membership within thirty (30) days for a full refund of thepurchase price paid by returning to the original issuing agency. After thirty (30) days, you may cancel this Membership in writing for apro-rata refund of the amount originally paid for the Membership, less any benefits paid for covered occurrences. Auto Knightreserves the right to cancel this Membership for the following reasons: Cancellation by Auto Knight for fraud or materialmisrepresentation on your part will be effective thirty (30) days after delivery or first-class mailing of a written notice to you.Cancellation by Auto Knight for non-payment of this Membership by you will be effective ten (10) days after delivery or first-classmailing of a written notice to you.
CHANGE OF ADDRESS OR CONTACT INFORMATION - If there are changes to your personal information, including name,address or telephone number, please notify the agency that issued this Roadside Assistance plan to you.
